On this page, we provide all the information that employees need to report any complaints related to irregular practices within our company or to prevent potential irregularities. 

What is a Complaint Channel? 
In accordance with Law No 93/2021 of 20 December ("Law"), which transposed into the legal system Portuguese Directive (EU) 2019/1937 of 23 October 2019 on the protection of persons reporting infringements of EU law, entities that employed 50 or more workers are required to have a complaints channel, to detect and prevent any irregular practices.
As a result, at Tecnibuild, we want to reinforce our transparency and commitment to our collaborators and partners, providing a guide to facilitate the reporting of any complaints, including anonymous reports. 

What to report? 
If you are aware of situations that may involve criminal activity or administrative offenses related to the following areas, you can report them:
• Public contracting;
• Financial services, products, and markets, and prevention of money laundering and terrorist financing;
• Product safety and compliance;
• Transport security;
• Environmental protection;
• Radiation protection and nuclear safety;
• Food and animal safety, animal health, and animal welfare;
• Public health;
• Consumer protection;
• Protection of privacy and personal data and security of the network and information systems;
• Act or omission contrary and harmful to the financial interests of the European Union referred to in Article 325 of the Treaty on the Functioning of the European Union;
• Act or omission contrary to the internal market rules referred to in Article 26(2) of the TFEU, including competition and state aid rules, as well as corporate tax rules;
• Violent crime, especially violent and highly organized, such as drug trafficking; terrorism; arms trafficking; influence peddling; undue receipt of advantage; active and passive corruption; embezzlement; money laundering; criminal association; child pornography and pimping of minors; damage related to programs or other computer data, computer sabotage and illegitimate access to a computer system; human trafficking; counterfeiting; pimping; smuggling; trafficking and addiction to stolen vehicles.

How does it work? 
The process is simple and involves just a few steps!
Step 1 – Choose a reporting channel: Select one of the available channels to make your complaint (email; phone; address);
Step 2 – Submit your report: Provide a description of the crime or suspected irregularities;
Step 3 - Wait for evaluation: Your complaint will be evaluated by the company.

How long does this process take? 
Upon your report, the complaint will be analysed internally. 
In a few days, you will be informed about the necessary requirements, the relevant authorities involved, and the form and admissibility of filing the complaint. 
Depending on the nature of the complaint, the relevant authority will be informed such as the Public Prosecutor's Office, criminal police bodies, Banco de Portugal, or others, as applicable. 
Consequently, and internal investigation will be carried, and the measures adopted will be communicated to the complainant once the process is concluded. 

Confidentiality
Tecnibuild's Complaints Channel is aimed exclusively at its employees, allowing them to report situations of non-compliance anonymously or identified, in writing or verbally.
It is managed internally by a suitable person appointed for this role, ensuring independence, impartiality, confidentiality and data protection. 
The identity of the complainant, as well as any information that may directly or indirectly reveal their identity, is treated with strict confidentiality. Access to this data is restricted to personnel responsible for receiving or following up on complaints. 
The identity of the whistleblower may only be disclosed in fulfilment of a legal obligation or court order. In such cases, the complainant will be informed in writing about the reasons for disclosing the confidential data. 

Processing of personal data
The processing of personal data under this law, including the exchange or transmission of personal data by the competent authorities, complies with the provisions of the General Data Protection Regulation, approved by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016.
This also complies with Law no. 58/2019, of 8 August, which ensures the implementation of Regulation (EU) 2016/679 in the national legal order, and Law 59/2019, of 8 August, which approves the rules on the processing of personal data for the purposes of the prevention, detection, investigation or prosecution of criminal offences or the execution of criminal penalties.
